Welcome to BetScanner ("the Platform", "we", "us", or "our"), a sports betting analysis and prediction service operated under the laws of the Federal Republic of Nigeria. These Terms of Service and User Agreement ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", "your") and BetScanner, governing your access to and use of our website, mobile applications, services, and all related features (collectively, the "Services").

These Terms are drafted in accordance with the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Nigerian Communications Act 2003, the Cybercrimes (Prohibition, Prevention, etc.) Act 2015, the National Lottery Act 2005, and all other applicable federal and state regulations governing digital services and gambling-related activities in Nigeria.
We reserve the right to modify, amend, or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting to the Platform. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2.1 Minimum Age Requirement: You must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction, whichever is greater, to access or use our Services. By creating an account, you represent and warrant that you meet this age requirement. Gambling by persons under the age of 18 is illegal under Nigerian law, and we strictly prohibit minors from using our Services.
2.2 Legal Capacity: You must have the legal capacity to enter into binding contracts under Nigerian law. If you are registering on behalf of a corporate entity, you represent that you have the authority to bind such entity to these Terms.

If you access our Services from outside Nigeria, you are responsible for compliance with local laws and regulations in your jurisdiction. 3.1 Account Creation: To access certain features of our Services, you must create an account by providing accurate, current, and complete information, including but not limited to your full name, email address, phone number, and password. You agree to maintain and promptly update your account information to ensure its accuracy.
3.2 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to protect your account credentials.
3.3 One Account Per User: You may only create and maintain one (1) account on the Platform. Multiple accounts created by the same individual are strictly prohibited and may result in immediate termination of all associated accounts without refund.
3.4 Account Transfer: Your account is personal to you and may not be transferred, sold, or assigned to any third party without our prior written consent.
3.5 Account Termination: We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice, if we believe you have violated these Terms or engaged in fraudulent, illegal, or abusive conduct. Upon termination, your right to access and use the Services will immediately cease.

5.2 Payment Processing: All payments are processed through secure third-party payment processors (including Paystack). By subscribing to a paid plan, you authorize us to charge your selected payment method for the applicable subscription fees.
5.3 Subscription Duration: Subscriptions are offered on a weekly, monthly, or other periodic basis as specified at the time of purchase. Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date.
5.4 No Refunds: All subscription fees are non-refundable. Once you have purchased a subscription, you will not be entitled to a refund for any unused portion of the subscription period, regardless of whether you actively use the Services during that period.
5.5 Price Changes: We reserve the right to change our subscription prices at any time. Price changes will apply to new subscriptions and renewals following the effective date of the price change. We will provide reasonable notice of price increases where required by law.
5.6 Taxes: All fees are exclusive of applicable taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes associated with your subscription.

6.2 No Liability for Losses: YOU ACKNOWLEDGE AND AGREE THAT BETSCANNER, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE HELD LIABLE, RESPONSIBLE, OR ACCOUNTABLE FOR ANY FINANCIAL LOSSES, DAMAGES, OR HARM ARISING FROM YOUR USE OF OUR SERVICES OR YOUR PARTICIPATION IN SPORTS BETTING ACTIVITIES. 9.1 Ownership: All content, materials, features, functionality, trademarks, service marks, logos, trade names, and intellectual property available on or through our Services (including but not limited to text, graphics, images, software, code, algorithms, predictions, analysis, and designs) are owned by BetScanner, our licensors, or other content providers and are protected by Nigerian and international copyright, trademark, patent, and other intellectual property laws.
9.2 Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services for your personal, non-commercial use only.
9.3 Restrictions: You may not copy, modify, distribute, sell, lease, rent, sublicense, or create derivative works based on our content or Services without our prior written permission. Any unauthorized use terminates the license granted herein.

TO THE MAXIMUM EXTENT PERMITTED BY NIGERIAN LAW, BETSCANNER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED NIGERIAN NAIRA (₦100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless BetScanner, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
14.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
14.2 Jurisdiction: You agree that any legal action or proceeding arising out of or relating to these Terms or your use of our Services shall be instituted exclusively in the courts of competent jurisdiction within the Federal Republic of Nigeria. You consent to the personal jurisdiction of such courts and waive any objection to venue.
14.3 Informal Resolution: In the event of any dispute, claim, or controversy arising from these Terms, you agree to first contact us to attempt to resolve the matter informally. We will make reasonable efforts to resolve disputes amicably.
14.4 Arbitration: If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration conducted under the Arbitration and Conciliation Act (Cap A18, Laws of the Federation of Nigeria, 2004) in accordance with the rules of the Lagos Court of Arbitration (International) or another mutually agreed arbitration body.
15.1 Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
15.2 Waiver: No waiver by BetScanner of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms, together with our Privacy Policy and any other legal notices or policies published by us on our Services, constitute the entire agreement between you and BetScanner concerning your use of our Services and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, between you and BetScanner.
We may assign or transfer these Terms, in whole or in part, to any third party without your consent or notice. You may not assign or transfer any rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this provision shall be null and void.
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, civil unrest, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
